En Panama, se reglamenta los servicios de Transporte de Lujo ofrecidos por medios de plataformas digitales (UBER-CABYFY, ETC.)

[:es]El  decreto ejecutivo N°331 del 31 de Octubre de 2017,  reglamenta el servicio de las plataformas digitales  que  se fundamentan en la solicitud de transporte particular y con conductor por medio de teléfonos inteligentes, entre otros.

Esta medida obedece a la necesidad de contar con normas que permitan a las autoridades gubernamentales llevar un control en el servicio de transporte de lujo que  brindan  este tipo de plataformas. Es por ello que en su Artiículo 1 establece que todo tipo de transporte ofrecido por medio de estas plataformas tecnológicas deben cumplir con las características y especificaciones que se incorporan en este Decreto Ejecutivo.

Uno de los puntos más importantes en este Decreto Ejecutivo es que sólo los nacionales pueden ser los propietarios de los vehículos utilizados para prestar este servicio o terceros debidamente autorizados y se les permitirá tener hasta dos autos para ofertar el  transporte en estas plataformas. Los vehículos deben contar máximo con 7 años de antigüedad y deben tener capacidad máxima de 7 pasajeros (Artículo 7).

Para hacer la diferencia entre el transporte público y este servicio de lujo, se ha estimado dentro de este decreto N° 331, que no se podrán brindar de forma directa el servicio en la vía ni se les permitirá contar con centrales (terminales o piqueras) donde los usuarios acudan a solicitar el servicio. El servicio sólo se brindará en las provincias de; Colón, Panamá, Panamá Oeste y Coclé, aquí se establecen las tarifas que indique la empresa que presta el servicio.

Otras de las disposiciones consiste en que cada vehículo utilizado en estas plataformas debe contar con una póliza de seguro comercial vigente de cobertura amplia que ampare al conductor y a los ocupantes del vehículo, según las exigencias de la Superintendencia de Seguros;  en caso que el seguro no se encuentre vigente y ocurra un accidente durante el servicio de transporte la empresa que brinda la tecnología será responsable por los daños causados, hasta por un monto igual de las sumas aseguradas en la póliza del seguro del vehículo.

En cuanto al conductor, debe  contar con 21 años de edad como mínimo, contar con una licencia de conducir expedida por la AUTORIDAD DE TRANSITO Y TRANSPORTE TERRESTE, debe estar registrado en el listado de Conductores de la plataforma y presentar su record policivo, por su parte la empresa deberá  tener publicado en su página de internet y aplicación inteligente el costo de los traslados con todas sus variantes o recargos.

El pago por este servicio puede ser en efectivo por espacio de seis meses tiempo que ha otorgado la AUTORIDAD DE TRANSITO Y TRANSPORTE TERRESTE, a estas empresas para que cumplan con los requerimientos establecidos en el Decreto Ejecutivo N°331.[:en]Executive Decree No. 331 of October 31, 2017 regulates the digital platform services which are based on the petition of private transportation with a driver by means of smartphones, to mention some.

This measure is the result of the need of relying on standards allowing governmental authorities to have control on the luxury transportation service offered by these type of platforms. Therefore, Article 1 establishes that any type of transportation offered by means of these technological platforms must comply with the characteristics and specifications included in this Executive Decree.

One of the most important points in this Executive Decree is that only national citizens can be owners of the vehicles used to offer this service or third parties duly authorized, and they will be allowed to have up to two automobiles to offer transportation in these platforms. Vehicles should not have more than 7 years of use and have a maximum capacity of 7 passengers (Article 7).

To discern between public transportation and this luxury service, it has been established in this Decree No. 331, that the service cannot be rendered directly on the streets nor shall they have centrals (cab terminals or stations) where the users can go and request the service. The service shall only be rendered in the provinces of Colon, Panama, Western Panama and Cocle. Rates indicated by the company rendering the service shall be established herein.

Another provision is that every vehicle used in these platforms must have a commercial insurance policy in force with extended coverage for the drive and the passengers, as required by the Superintendency of Insurance. In case the policy is not in force and there is an accident during the transportation service, the company offering the technology shall be responsible for the damages caused, up to an amount equal to the amounts insured in the insurance policy of the vehicle.

In relation to the driver, he must be a minimum of 21 years old, have a driver’s license issued by the Transit and Land Transport Authority, must be registered under the list of Drivers of the platform and submit his/her criminal record. The company must publish in its Internet page and application the cost for the transfer with all its variants or surcharges.

Payment for this service can be in cash for a period of six months, which is the period the TRANSIT AND LAND TRANSPORT AUTHORITY has granted to these companies to comply with the requirements established in Executive Decree No. 331.[:]
